The Ministry of Labour, Social Security and Third Sector is advising all employers, employees, and their representatives that two new Regulations and an Order to the Safety and Health at Work Act (SHAW Act) have now been made.

The Safety and Health at Work (Refusal of Dangerous Tasks) Regulations, 2023; Safety and Health at Work (Forms) Regulations, 2023, and the Safety and Health at Work (Accident Report) (Fees) Order, 2023 were published in the Official Gazette VOL. CLVIII No. 40, on April 24, 2023.

The Safety and Health at Work (Refusal of Dangerous Tasks) Regulations, 2023 gives guidance on the application of Section 104 of the SHAW Act, which allows employees to refuse to conduct tasks that present an imminent danger to their life and limb.

The Safety and Health at Work (Forms) Regulations, 2023 contains the statutory forms that certify the safe use of equipment, including passenger lifts and steam boilers, while the Safety and Health at Work (Accident Report) (Fees) Order, 2023 states the fee to be paid to the Chief Labour Officer in order to obtain a report of an accident investigated by the Labour Department.

The SHAW Act, which was enacted in 2013, aims to secure the provisions of safety, health and welfare for persons at work as well as those who may be affected by the activities conducted at work.
